OUI Suspension Periods.

How long does Maine suspend for OUI? 

The State of Maine will issue the following license suspensions for a person convicted (found guilty in court) or administratively adjudicated (BMV hearing) of committing the following OUI offenses:


Provisional Licenses

  • Provisional License Holder (under 21) — 12 months.

  • Provisional License Holder (under 21) Test Refusal — 18 months.

  • 2nd Offense on Provisional License — 24 months.

  • 2nd Offense on a Provisional Licence Test Refusal — 30 months


OUI Convictions

  • 1st Offense OUI — 150 days (eligible for IID after 30 days).

  • 2nd Offense OUI — 3 years (eligible for IID after 9 months)

  • 3rd Offense OUI — 6 years (eligible for IID after 3 years).

  • 4th Offense OUI — 8 years (eligible for IID after 4 years).


Test Refusals

  • 1st Offense OUI Test Refusal — 275 days.

  • 2nd Offense OUI Test Refusal — 18 months.


Commercial Driver License

  • 1st Offense — 1 Year Suspension.

  • 2nd Offense — Lifetime Suspension.


Aggravated OUI and Manslaughter

  • Aggravated OUI Causing Serious Bodily Injury — 6 Years.

  • Aggravated OUI Causing a death — 10 years.

  • Manslaughter Conviction — 5 years.

  • Manslaughter Conviction While Under the Influence of Alcohol or Drugs — Indefinite Suspension for at least 10 years.
