If you hold a commercial driver’s license (CDL), a Maine OUI conviction can result in a one year CDL suspension for a first offense OUI, and a lifetime suspension for a second offense OUI.
The Federal Motor Carrier Safety Administration (FMCSA) regulations consider a CDL driver to be driving under the influence of alcohol if their BAC is 0.04 percent or higher while operating a commercial vehicle.
You do not need to be operating a commercial vehicle in order to lose your CDL. An OUI conviction, or BMV adjudication, that you were operating a non-commercial vehicle with a BAC of 0.08 or higher will result in a suspension of your CDL.
